1. OBJECT AND SCOPE

1.1 Purpose of the Terms and Conditions

These Terms and Conditions (hereinafter, 'Terms') govern access to and use of the Salud En Ruta website, as well as the contracting of home healthcare services provided by the business, in accordance with applicable laws in Spain and the Community of Madrid.

1.2 Scope of Application

These Terms apply to the use of the health services provided by Salud En Ruta through its online platform, as well as through any other channel enabled by the business (e.g., phone, email, etc.). By contracting a service, the user agrees to comply with the conditions described herein.

2. TERMS OF USE

2.1 Proper Use of Services

The user agrees to use the services ethically, legally, and in accordance with professional best practices, without violating provisions of the Penal Code, Civil Code, General Law for the Defense of Consumers and Users, and any other applicable Spanish legislation.

2.2 User Responsibility

The user guarantees that the information provided at the time of contracting is truthful, complete, and up-to-date, especially concerning medical data, clinical history, and emergency contact information.

3. DESCRIPTION OF SERVICES

3.1 Services Provided

Salud En Ruta offers home medical services in the Community of Madrid, including general medical consultations, emergency care, physiotherapy, nursing, palliative care, among others.

3.2 License and Quality of Services

All professionals providing the services are duly accredited, registered, and authorized according to the requirements of Spanish healthcare legislation, particularly Law 41/2002, on patient autonomy, and the regulations of Royal Decree 459/2010.

4. CONTRACTING PROCEDURE

4.1 How to Contract

To contract the services, the user may do so through Salud En Ruta's online platform, by phone, or by email. Once the request is received, a confirmation will be sent detailing the service terms, price, and the date and time of the medical visit.

4.2 Confirmation and Acceptance

The service contract is considered valid once the user receives an express confirmation from Salud En Ruta, subject to the availability of healthcare staff.

5. PRICES AND PAYMENT

5.1 Prices

Service prices are clearly and thoroughly indicated before contracting, and include all applicable taxes under current legislation (VAT). Salud En Ruta reserves the right to modify prices at any time, but will ensure that changes do not affect already contracted services.

5.2 Payment Methods

Users may pay for the services by credit card, bank transfer, or cash, as stipulated in each case. For users with health insurance, the cost may be fully or partially covered by the insurance provider, according to the current contract.

5.3 Invoices and Receipts

The user will receive an invoice or receipt for the services provided, which will include all details of the service, the date, the total cost, and any applicable taxes.

6. CANCELLATIONS AND RETURNS

6.1 Cancellation by the User

The user may cancel or modify the appointment with a minimum notice of 6 hours before the scheduled service time. If the cancellation occurs after this period or in the case of no-show, a full charge of the amount may apply.

6.2 Cancellation by us

Salud En Ruta reserves the right to cancel any appointment or service in case of force majeure, such as emergencies or unforeseen situations that prevent the service from being provided.

6.3 Returns

If the user believes that the service has not been provided as agreed, they may request a refund or adjustment of the amount. Returns will be processed within 7 business days following the request, in accordance with consumer protection regulations.

7. LIMITATION OF LIABILITY

7.1 Disclaimer of Liability

Salud En Ruta will not be liable for indirect, incidental, punitive damages or loss of profits arising from the use of the services, except in cases of fraud or gross negligence.

7.2 Third-Party Services

Salud En Ruta may recommend, offer, or include links to third-party services (such as insurers or medical equipment providers). However, Salud En Ruta does not assume any responsibility for the quality, safety, or reliability of these services.

8. PERSONAL DATA PROTECTION

8.1 Compliance with Legislation

Personal data of users will be processed in accordance with the General Data Protection Regulation (EU 2016/679) and Organic Law 3/2018.

8.2 Purposes of Data Processing

The personal and medical data collected will be used solely for providing the requested services, administrative management, and compliance with legal obligations.

8.3 User Rights

The user has the right to access, rectify, delete, or limit the processing of their personal data at any time, in accordance with applicable legislation.

9. INTELLECTUAL AND INDUSTRIAL PROPERTY

9.1 Copyright

All content provided by Salud En Ruta on its platform, including texts, images, logos, and designs, are the exclusive property of the business or its licensors.

9.2 Unauthorized Use

The user agrees not to use, copy, distribute, or reproduce the content without the express authorization of Salud En Ruta.

10. JURISDICTION AND APPLICABLE LAW

10.1 Applicable Law

These Terms and Conditions will be governed by and construed in accordance with Spanish law.

10.2 Dispute Resolution

Any dispute arising from the interpretation or execution of these Terms will be submitted to the jurisdiction of the competent courts of the Community of Madrid.

11. MODIFICATIONS TO THE TERMS AND CONDITIONS

11.1 Right to Modify

Salud En Ruta reserves the right to modify these Terms at any time, adapting them to any legal changes that may occur.

11.2 Notification of Changes

Modifications to these Terms will be published on the website and will take effect from the date of publication.
